Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Fitconnect mobile application ("App"), a gym membership management system developed and operated by MMS GENIE PVT LTD ("we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.


1. Use of the App

Fitconnect allows users to:

  • Register and manage gym memberships

  • Track fitness data including height, weight, steps, calories, and sleep

  • Sync with Apple Health and Google Fit

  • Make payments for gym-related services via PayHere

You must be at least 13 years of age (or the legal age of digital consent in your country) to use the app.


2. Account Registration

To use certain features, you must create an account by providing accurate and complete information. You are responsible for:

  • Keeping your login credentials confidential

  • All activity that occurs under your account

  • Updating your information to keep it accurate and current

We reserve the right to suspend or terminate your account if we believe your information is false, misleading, or violates these Terms.


3. Membership Management

The App provides tools to manage gym memberships, including:

  • Selecting plans offered by participating gyms

  • Viewing attendance history and membership status

  • Renewing memberships (if permitted by the gym)

Fitconnect is not responsible for the quality or availability of services provided by third-party gyms.


4. Health and Fitness Data

You may optionally connect your device’s Apple Health or Google Fit accounts to sync data. By doing so, you grant Fitconnect access to specific health metrics such as:

  • Steps taken

  • Calories burned

  • Sleep duration

  • Heart rate

You can disable this access at any time via your device settings.


5. Payments

Payments made through the App are processed securely via PayHere (https://www.payhere.lk). By using this payment gateway, you agree to PayHere’s terms and conditions, including:

  • PayHere Privacy Policy

    This Privacy Policy explains how payments are processed through PayHere when you make purchases via the Fitconnect app.

    When you make a payment through Fitconnect, the transaction is securely processed by PayHere (Private) Limited. By completing a payment, you agree to PayHere’s data handling practices as described below.

    1. Information Collected

    When you make a payment, PayHere may collect:

    • Your name and contact details (email, phone number)

    • Payment card details (securely processed, not stored by Fitconnect)

    • Billing and shipping information (if applicable)

    • Transaction details such as amount, date, and reference number

    2. Use of Information

    PayHere uses your payment information to:

    • Process and complete your payment

    • Prevent fraud and ensure security

    • Comply with applicable legal and regulatory requirements

    3. Data Security

    All payments are processed through PCI-DSS compliant secure payment gateways. PayHere uses encryption, tokenization, and other industry-standard safeguards to protect your information.

    4. Data Sharing

    PayHere may share transaction data with:

    • Banks and payment processors

    • Law enforcement authorities, when required by law

    • Fitconnect (limited to payment confirmation and reference details only)

    5. Your Rights

    You may request details of your payment transaction from PayHere by contacting their support team:

  • PayHere Refund Policy

    This Refund Policy outlines how refunds are handled for payments made through Fitconnect via PayHere.

    By completing a payment, you acknowledge and agree to the following refund terms:

    1. Refund Eligibility

    Refund requests will only be processed if:

    • You are eligible for a refund under the terms of your gym membership or subscription plan

    • You provide proof of payment and a valid reason for the refund request

    • The refund request is made within the time frame specified by your gym or Fitconnect’s internal policy

    2. Refund Process

    • Refunds are initiated by Fitconnect after verifying your request

    • Once approved, refunds will be processed to the original payment method

    • Refunds may take 7–14 working days to reflect in your account, depending on your bank or card issuer

    3. Non-Refundable Transactions

    Payments may be non-refundable in the following cases:

    • Services already used or accessed

    • Promotional offers or discounted plans clearly marked as non-refundable

    • Late refund requests beyond the eligible period

    4. Dispute Resolution

Please note that we do not store or process your credit/debit card details directly.


6. User Conduct

You agree not to:

  • Use the App for any unlawful purpose

  • Attempt to gain unauthorized access to other users’ data or accounts

  • Interfere with the app’s security, functionality, or availability

  • Use automated systems (e.g., bots or scrapers) without permission

Violation of this section may result in suspension or permanent termination of your account.


7. Intellectual Property

All content in the App, including logos, software, text, graphics, and design, is the intellectual property of Fitconnect or its licensors. You may not use, reproduce, distribute, or create derivative works without prior written consent.


8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee:

  • That the app will be error-free, uninterrupted, or secure

  • The accuracy or reliability of health data or gym service listings

  • That syncing with Apple Health or Google Fit will always work as expected

Use of the app is at your own risk.


9. Limitation of Liability

To the fullest extent permitted by law, Fitconnect shall not be liable for:

  • Any indirect, incidental, or consequential damages

  • Loss of data, membership access, or payments due to third-party failures

  • Disputes between you and your gym or fitness provider

In no event shall our total liability exceed the amount you paid, if any, for use of the app in the preceding 3 months.


10. Termination

You may terminate your use of the app at any time by deleting your account. We may suspend or terminate your access if:

  • You violate these Terms

  • Required by law

  • There are security or fraud concerns

Termination will not affect your obligation to pay any outstanding fees, nor limit our rights to seek damages.


11. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you within the app or via email. Continued use of the app after such changes constitutes acceptance of the updated Terms.


12. Governing Law

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law provisions. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
